it already is a crime. its called contempt of court, obstruction of justice, tampering with evidence. he is openly admitting that he broke the law. but he works for the government so the law doesn't apply to him. laws only exist to constrain citizens

you justifications for the current system involves a situation where war had been declared. When war is declared, there are real legal consequences. but war has not been declared. AUMF is NOT a war declaration. Therefore, that argument does not hold.

please address jose padilla. please address al-qaeda's spread. how do you defeat a leaderless, ideologically spread organization? These are important questions.

This war on terror will never end. Civil liberties will never be restored. No one in the government will be held accountable for their crimes.

They said an end to an effective AQ by a destruction of it's leadership globally, it's ability to wage terror campaigns via supply, finances, and access to willing new members. They have almost done this completely since Gates and Obama have started working on this.

Then why the escalation of drone strikes in Yemen? Why do they continue in Pakistan? Why their spread to the Philippines and Somalia?

Al-qaeda is not an organization. It is an ideology. How do you defeat an ideology? In the war of ideas, we have failed. We are more hated by muslims now than before 9/11. We can kill the leaders of al-qaeda, but they will always find new people. People will read their ideology on the internet and be unilaterally inspired to carry out attacks.

There is no declaration of war, so anti-terrorist operations must be carried out as law enforcement activity. But it is not being done that way, even to americans. Go look at the case of Jose Padilla.

Ok, so there are a few problems here. I guess I will go point by point. Also, did you read this greenwald post on NDAA? The things you say he did wrong, he didn't actually do. http://www.salon.com/2011/12/16/three_myths_about_the_detention_bill/

  1. In that post, he doesn't link all terrorists to the bill. He is explicit with the language. Here is a quote: "It allows the President to target not only those who helped perpetrate the 9/11 attacks or those who harbored them, but also: anyone who “substantially supports” such groups and/or “associated forces.” Those are extremely vague terms subject to wild and obvious levels of abuse (see what Law Professor Jonathan Hafetz told me in an interview last week about the dangers of those terms). "

Furthermore, as the supreme court ruled, offering non-violent training to individuals involved with state department listed terrorist organizations amounts to aiding a terrorist organization. http://en.wikipedia.org/wiki/Holder_v._Humanitarian_Law_Project

Under NDAA, you could be jailed indefinitely for this.

  1. Please show me one government official who as defined what the end of hostilities means. The fact is the threat of terrorism is so amorphous, so unstoppable that it will never end. The American public and government have the wrong picture about the way al-qaeda works. it is not an organization. It is not an institution. It is a religious and political ideology that uses the tactics of terrorism. How do you define when tha is defeated? The fact is, you can't. All it takes for someone to join al-qaeda is to say "i join al-qaeda". You or I could join al-qaeda from our homes right now. There is no way to degrade that completely. It will always be there. And also, dont think the US has suddenly won over muslims. Arab opinion of the US has deteriorated since 9/11. The only thing that has repudiated al-qaeda and their tactics has been the arab spring, which the US government generally opposed. These leaders were our men. We were the reason they stayed in power.

Also, the WWII examples are not the same. Yes, the government can suspend constructional rights when a war has been declared. But we don't declare wars anymore. How can you declare war against a non-state? you can't. Bringing terrorists to justice is not a war. It is law enforcement. Under law enforcement, people have rights.

  1. the bill's language says that it has no effect on the standing legality of arresting american citizens in america on terrorism charges and holding them militarily. in fact this has already been made legal, check out the case of jose padilla
